Another major upside of a 51–49 Senate, as opposed to 50-50. Dems have a majority is on committees and can issue subpoenas and thus act as a potential counterbalance if House goes off the rails. In current 50–50 split, they need some R support to do that.

Judge Carter's ruling finding crime fraud exception is much tougher and more foreboding on Trump than the previous one. That's b/c he finds more likely than not that Trump signed a false certification as part of the effort to overturn Georgia results. DOJ will have to follow up.

Graham loses appeal in 11th Circuit and now the path is cleared for him to have to testify in Fulton County. As I've noted, he's in a different place a sitting Senator from others in the Trump circle, because I think it's harder for him to take the 5th Am. w/o political costs.

DOJ has now filed its brief in the 11th Circuit appealing Judge Cannon's order. (It previously appealed from the stay, and the 11th Cir reversed the stay and the Sup Ct yesterday denied review.). It's very strong. Highlights: 1) Cannon shouldn't have exercised jurisdiction
